Product Guarantee

At 5 Star Cases, we are proud of the quality of our products and workmanship.

We are therefore pleased to offer a 2-year manufacturer’s guarantee on all our products (subject to some exclusions*) as detailed in our terms and conditions below.

Our Guarantee

We guarantee that on delivery and for a period of two (2) years starting from the original date of delivery (with the exception of any foam, carpet lining, ProTect and Mossman products, see below*) (guarantee period) your product will be free from material defects in design, material and workmanship under normal commercial use and conditions, and will conform in all material respects with its description and any applicable specification, subject to the terms and conditions set out below.

*ProTect Bags, Mossman Trunks and any foam and/or carpet interior lining in any of our products, are guaranteed for a period of one (1) year from the original date of delivery (guarantee period), subject to the terms and conditions set out below.

Our guarantee is given in respect of products purchased within the United Kingdom and applies to the original purchaser only. Our guarantee will be governed by the law of England and Wales and subject to the courts of England and Wales.

This guarantee does not affect, and is in addition to, any statutory rights you may have in respect of the product as a consumer. For non-consumers, any implied warranty of condition of merchantability, satisfactory quality, or fitness for a particular purpose is limited to the extent permitted by law to our standard guarantee.

What is covered? 

If, during the guarantee period, you notify us in writing that your product does not comply with our guarantee, we will (subject to remaining terms of this guarantee), at our option:

  • Repair the product; or
  • Replace the product with a repaired, refurbished, or newly built product of equal specification in which case the original product must be returned to us.

Any repair or replacement is subject to proof of purchase, and verification of the defect by us. You must allow us reasonable access to the product or (if asked to do so by us) return the product to us at your cost so that we can examine it.

Repairs must only be carried out by us, or someone appointed by us. If we repair or replace a product under this guarantee, this does not extend the guarantee period; the original guarantee period will continue to apply to the repaired or replacement product.

What is not covered?

We will not be liable for any failure of the product to comply with our guarantee if:

  • The defect results from a failure to follow our instructions as to the storage, use, cleaning, and maintenance of the product or (if there are none) good trade practice regarding the same.
  • The defect arises due to you supplying us with an incorrect drawing, design, or specification for the product.
  • You modify or repair the product without our written consent.
  • You continue using the product after notifying us that the product is defective.
  • The defect arises from accidental damage, fair wear and tear, wilful damage, improper use, negligence, abuse of the product, or abnormal storage or working conditions.
  • The defect arises from incorrect, inappropriate, or inadequate cleaning, maintenance, or care, or during transportation or delivery.

Any marks, scratches, and deterioration of foam and carpet linings are normal and considered fair wear and tear.

Except as provided in these terms and conditions, and to the extent permitted by law, we shall not be liable for any financial losses arising as a result of any defect in the product. Financial loss includes but is not limited to loss of profits, loss of sales or business, loss an anticipated savings, loss of income, loss of or damage to goodwill, loss of agreements or contracts, or any indirect or consequential losses.

Making a Claim

Please ensure that you keep your purchase receipt or other proof of purchase safe as you will need it to claim under this guarantee.

Claims for defective products must be made within the warranty period.

Claims for missing parts must be made within 60 calendar days after the date of delivery of the product.

We reserve the right to specify that items be returned to the factory for inspection or be inspected by our representative at your premises. The cost and risk of return of the product to the factory will be the responsibility of the purchaser.
